Terms of Service

Acceptance of Terms

By accessing or using DigiQSL, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the service.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account.

User Content

You retain ownership of the content you submit to DigiQSL, including text, QSL designs, QSO and logbook data, uploaded files, messages, and contact details. By submitting content, you grant us a non-exclusive license to host, store, reproduce, process, transmit, and display that content as reasonably necessary to provide, secure, review, enforce, and improve the service. You represent that you have the rights, permissions, and lawful basis needed to submit that content and to instruct DigiQSL to process any sender or recipient contact details you provide.

User-Initiated QSL Email Sending

DigiQSL allows users to initiate QSL and related emails to other users or third-party recipients. These communications are initiated at your direction and for your benefit. DigiQSL may transmit those messages through DigiQSL-managed infrastructure and may use DigiQSL-controlled sending addresses or headers for deliverability, while also using the initiating user's reply-to address or other user-supplied sender context where applicable.

  • You are responsible for the recipients you choose, the contact details you provide or confirm, the content you send, and your compliance with applicable privacy, anti-spam, and communications laws.
  • You must only initiate communications you are authorized to send and must not use DigiQSL to impersonate, harass, deceive, or send unsolicited bulk or abusive messages.
  • We may queue, review, rate limit, delay, reject, or block transmissions to protect the platform, recipients, and other users.
  • We do not guarantee message delivery, inbox placement, acceptance by the recipient's mail provider, response rates, or the ongoing accuracy of third-party contact data.

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Upload content that infringes on intellectual property rights
  • Interfere with the operation of the service
  • Impersonate others or provide false information
  • Share your account credentials with others
  • Use DigiQSL for spam, unsolicited bulk messaging, harassment, or deceptive communications
  • Use, collect, scrape, or submit recipient contact data without proper authorization or in violation of applicable law
  • Attempt to bypass queues, rate limits, moderation, security controls, or abuse-prevention measures

Enforcement and Suspension

We may investigate suspected misuse of DigiQSL and may remove content, refuse transmissions, limit features, suspend accounts, terminate access, or take other reasonable enforcement action if we believe the service is being misused, used unlawfully, used to evade platform controls, or used in a way that puts DigiQSL, recipients, or other users at risk.

Account Closure and Historical Records

If you close or delete your account, DigiQSL may retain QSO records, QSL confirmation data, matched confirmation links, historical QSL snapshots, and related metadata, assets, or references where reasonably necessary to preserve two-way confirmation integrity, maintain other users' records, investigate abuse, comply with legal obligations, or maintain legitimate business records. Account closure or deletion will not necessarily remove, revoke, or invalidate confirmations, historical records, or records that have become part of another user's activity history.

Paid Features and Premium Access

When DigiQSL offers paid features, subscriptions, or one-time upgrades:

  • All paid purchases are final, non-refundable, and non-transferable except where required by applicable law.
  • Paid access is personal to the purchasing account and may not be shared, resold, assigned, gifted, or otherwise transferred.
  • We may suspend, limit, or terminate paid access without refund if we reasonably believe an account has been shared, abused, used to evade platform limits, involved fraud, suspicious activity, or otherwise violated these Terms.
  • Paid features, benefits, and limits may change, improve, or be removed over time as DigiQSL evolves, and no purchase guarantees that any specific feature, integration, limit, or uptime level will remain available indefinitely.
  • If we offer a "Lifetime" upgrade, "Lifetime" refers to the lifetime of that offering within DigiQSL and the continued operation of the relevant service, not the lifetime of the purchaser. If the service or offering is discontinued, materially changed, or replaced, no refund, exchange, credit, or cash equivalent will be owed except where required by law.

Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time. DigiQSL depends on internet connectivity, email infrastructure, third-party mail providers, hosting, and other external systems, so we do not guarantee uninterrupted availability, continuous feature access, message delivery timing, inbox placement, or successful delivery to every intended recipient.

Limitation of Liability

To the maximum extent permitted by law, DigiQSL shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages resulting from your use or inability to use the service, including lost data, failed or delayed communications, recipient-side mail filtering, third-party service outages, or loss of access to optional features.

Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of the overall use framework for DigiQSL.
